New York Birth Defect Attorneys Filing Zofran Lawsuits

Numerous studies have been carried out in countries like the United States, Denmark, Sweden and China, and the studies have seen a correlation between the use of Zofran and the occurrence of some types of birth defects like cleft palate and congenital heart abnormalities. One of the studies by BioMed Research International which was conducted by the doctors in Australia, looked at births in Western Australia from 2002 to 2005, for a total of 96,968 births. The doctors wanted to find out the effects of using Zofran while pregnant. Zofran was prescribed to a number of women while others were not. Of those who used Zofran, they used it during their first trimester. The results, among others, showed a 20 per cent increased chance of a serious birth abnormality in babies exposed to Zofran in utero in the critical first three months of development.

Zofran is an anti-nausea and vomiting drug that was approved for use by the Food and Drug Administration (FDA) in 1991. Its intended and approved use was for cancer and post operative patients experiencing extreme nausea due to their radiation therapy and operative procedures. At no time did the FDA give the go ahead for Zofran to be used as anti-nausea drug for pregnant women experiencing serious morning sickness. This misleading use of Zofran has seen hundreds of lawsuits being filed against GlaxoSmithKline (GSK), for the wrong promotion of their drug, with litigants saying Zofran caused their children to be born with serious birth defects.

According to the Center For Disease Control 1 in 33 births in the United States has a documented child birth defect. The New York State Health Department reports that every 4.5 minutes a baby is born with a birth abnormality. The root cause of the birth defects vary from genetic predispositions, medical wrong doing, even drugs used while pregnant. In 2014 the population estimate for New York State was 19,746,227. The most populous cities of New York State are as follows:
